Welcome to Rent Galah! Rent Galah is a platform designed to bring transparency to the residential rental market by allowing users to share and access information about rental properties through property-specific message streams. These Terms and Conditions govern your use of the Rent Galah platform. By accessing or using Rent Galah, you agree to comply with and be bound by these terms. If you do not agree to these terms, please do not use the platform.

2. Account Registration

To use Rent Galah, users are required to create an account. By creating an account, you agree to provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. User Content and Conduct

By using Rent Galah, you agree to:

Ensure your content is truthful, accurate, and not defamatory.
Refrain from using offensive, abusive, or harassing language.
Avoid sharing content that infringes on someone else’s privacy or intellectual property rights.
Respect the rights of others, including not posting personal information without consent.
Avoid posting content unrelated to the property (e.g., spam or off-topic messages) or intentionally misleading information about a property’s condition or history.
Follow any community standards or moderation policies we set.

4. Disclaimer of Liability and Warranties

Rent Galah provides a platform for users to share and access information about rental properties. The content on Rent Galah is user-generated, and we do not verify, endorse, or guarantee the accuracy, completeness, or reliability of any information posted by users. This includes any reports generated by the platform about real estate agents, agencies, or landlords, which are based solely on user-submitted data and are not independently verified.

By using Rent Galah, you acknowledge that:

Any reliance on user-submitted content, including generated reports, is at your own risk.
We are not responsible for any disputes, losses, damages, or legal consequences that arise from information posted on the platform.
Rent Galah is provided on an “as-is” and “as-available” basis, without warranties of any kind, express or implied. We do not guarantee uninterrupted, error-free, or secure access to the platform.
We disclaim all liability for any indirect, incidental, consequential, or punitive damages resulting from the use of Rent Galah.

5. Termination and Suspension of Accounts

Rent Galah reserves the right to suspend or terminate any user account at its sole discretion if the user:

Violates these Terms and Conditions, including but not limited to posting false, defamatory, or harmful content.
Engages in harassment, threats, or any form of abusive behavior toward other users.
Attempts to manipulate or disrupt the platform’s functionality or security.
Fails to comply with applicable laws or regulations.

In the event of termination or suspension, Rent Galah may, at its discretion, notify the user or provide an explanation. However, Rent Galah is not obligated to provide such notice and may take action without prior warning. Upon termination or suspension, the user’s account details will be deleted, but their posts in property message streams will remain.

6. Privacy and Data Handling

By using Rent Galah, you acknowledge and consent to the collection, storage, and processing of your personal information as described in our Privacy Policy. We take the privacy and security of your data seriously and are committed to protecting it in accordance with applicable laws and regulations.

We collect and process the following types of data:

Personal Information: Information you provide when creating an account, such as your name, email address, and contact details.
User-Generated Content: Information you submit or share through the platform, such as messages, reviews, and feedback.
Usage Data: Information automatically collected when you use the platform, such as device information, IP address, and browsing behavior.

We use your data for the following purposes:

To provide and improve our services.
To communicate with you, including sending updates or notifications related to your account.

7. Dispute Resolution

Any disputes or claims arising from or related to the use of Rent Galah shall be resolved in good faith through negotiation. If the dispute cannot be resolved through negotiation, the parties agree to attempt mediation with a neutral mediator in accordance with the laws of New South Wales, Australia. If mediation fails to resolve the dispute within a reasonable time, the parties agree to submit the dispute to binding arbitration under the same laws.

The mediation and arbitration shall take place in Sydney, New South Wales, unless otherwise agreed by the parties. The prevailing party in any arbitration proceeding shall be entitled to recover their reasonable attorney fees and costs from the other party.

By using Rent Galah, you agree to this dispute resolution process and waive any right to bring a class action or seek relief in any other court or forum.

8. Changes to Terms and Conditions

Rent Galah reserves the right to modify or update these Terms and Conditions at any time. Any changes will be posted on this page, and the date of the most recent update will be indicated at the top of the page. For significant changes, we will also notify users via email or in-app notification, where feasible.

It is your responsibility to review these Terms and Conditions periodically to stay informed of any updates. By continuing to use Rent Galah after any changes have been made, you agree to be bound by the revised Terms and Conditions. If you do not agree with the updated terms, you must stop using the platform.
