1. Introduction

Welcome to RentGalah! RentGalah is a web and mobile platform that promotes transparency in the residential rental market by enabling users to share and view information about rental properties via property-specific message streams.

These Terms and Conditions (“Terms”) govern your access to and use of RentGalah. By accessing or using the platform (including creating an account or posting content), you agree to be bound by these Terms. If you do not agree, do not use RentGalah.

These Terms should be read alongside our Privacy Policy.

2. Account Registration

To use RentGalah, you must create an account. By creating an account, you agree to:

  • Provide accurate, complete, and up-to-date information.
  • Maintain the confidentiality of your account credentials (e.g., password).
  • Accept responsibility for all activities that occur under your account.

You must be at least 13 years of age to create an account. If you are under 18, you must have parental or guardian consent.

We reserve the right to refuse or revoke registration at our discretion.

3. User Content and Conduct

RentGalah allows you to post text and images in property-specific message streams. By submitting content, you represent and warrant that:

  • Your content is truthful, accurate, and not defamatory, misleading, or harmful.
  • You will not use offensive, abusive, harassing, or discriminatory language.
  • You will not infringe on others’ privacy, intellectual property rights, or other rights (e.g., no posting personal information without consent).
  • You will not post spam, off-topic messages, advertisements, or intentionally false information about properties.
  • You comply with all applicable laws, including Australian Consumer Law and anti-discrimination laws.

You grant RentGalah a non-exclusive, royalty-free, worldwide licence to host, display, reproduce, and distribute your content on the platform for its operation and promotion.

We may moderate, remove, or edit content that violates these Terms or our community guidelines, without notice. We are not obligated to monitor all content but reserve the right to do so.

4. Disclaimer of Liability and Warranties

RentGalah is a platform for user-generated content. We do not verify, endorse, or guarantee the accuracy, completeness, or reliability of any user-submitted information, including posts, reviews, or generated reports (e.g., about agents, agencies, or landlords).

By using RentGalah, you acknowledge that:

  • Reliance on any content is at your own risk.
  • We are not liable for disputes, losses, damages, or legal issues arising from platform content or use.
  • The platform is provided “as is” and “as available,” without warranties of any kind, express or implied (including fitness for purpose or merchantability), to the extent permitted by law.
  • We do not guarantee uninterrupted, error-free, or secure access.

To the maximum extent permitted by law (including Australian Consumer Law), we disclaim liability for any indirect, incidental, consequential, special, or punitive damages arising from your use of RentGalah.

5. Termination and Suspension of Accounts

We may suspend or terminate your account at our sole discretion if you:

  • Violate these Terms, including posting prohibited content.
  • Engage in harassment, threats, or abusive behaviour.
  • Attempt to disrupt the platform’s functionality or security.
  • Fail to comply with laws or regulations.

We may provide notice or explanation but are not obligated to do so. Upon termination, your account access will end, and we may delete your personal information (subject to our Privacy Policy). However, your posts may remain in message streams (anonymised where possible) to maintain continuity for other users.

You may terminate your account at any time via the settings.

6. Privacy and Data Handling

Your use of RentGalah is subject to our Privacy Policy, which explains how we collect, use, share, and protect your personal information. By using the platform, you consent to these practices.

We do not sell your personal information without consent, except as described in the Privacy Policy or required by law.

7. Dispute Resolution

Any disputes arising from these Terms or your use of RentGalah should first be resolved through good-faith negotiation.

If unresolved, the parties agree to mediation in New South Wales, Australia, with a neutral mediator under Australian Mediation Association rules.

If mediation fails, disputes will be resolved by binding arbitration in Sydney, New South Wales, under the laws of New South Wales and the Commonwealth of Australia.

The prevailing party may recover reasonable legal costs. You waive any right to class actions or jury trials.

These Terms are governed by the laws of New South Wales, Australia.

8. Changes to Terms and Conditions

We may update these Terms at any time. Changes will be posted here, with the updated date at the top. For material changes, we will notify you via the platform or email (if provided).

Your continued use after changes constitutes acceptance. If you do not agree, stop using RentGalah.

9. Miscellaneous

  • Intellectual Property: RentGalah owns all rights to the platform, excluding user content. You may not copy, modify, or reverse-engineer the platform.
  • Indemnity: You agree to indemnify RentGalah against claims arising from your content or use of the platform.
  • Severability: If any provision is invalid, the rest remain enforceable.
  • No Waiver: Failure to enforce any term does not waive our rights.
  • Entire Agreement: These Terms constitute the full agreement between you and RentGalah.
